UBS whistle-blower in prison - Tulsa World Posted: 09 Jan 2010 08:01 AM PST MINERSVILLE, Pa. — A former banker who provided key assistance in the U.S. tax evasion probe of Swiss banking giant UBS AG reported to prison Friday and said his cooperation should have earned him the federal government's gratitude, not prison time.
Bradley Birkenfeld, 44, a former private banker for UBS, said his whistle-blowing exposed "the largest tax fraud in the world" and allowed the Internal Revenue Service to recover billions of dollars in lost revenue. Birkenfeld, who handled funds of wealthy American clients of UBS from 2001 through 2006, pleaded guilty in June 2008 to a single count of conspiracy to defraud the U.S. and was sentenced to more than three years in prison. "I think it's an injustice," he said Friday as he reported to a federal prison to begin his sentence. "I'm a proud American who did the best I could for my country, and this is how they reward me." Birkenfeld admitted helping clients hide hundreds of millions of dollars and evade U.S. taxes. His sentence has drawn criticism from whistle-blower advocates as too harsh because of Birkenfeld's importance in exposing tax evasion at UBS. The Swiss bank last year paid a $780 million fine to the U.S. and agreed to turn over the names of 4,450 suspected tax dodgers. Birkenfeld began providing inside information to U.S. authorities in 2007, describing how UBS helped rich Americans hide income from the IRS. Prosecutors have said Birkenfeld did not initially reveal his own misconduct. He denies that. Foreclosure filings dropped in Licking County in 2009 - Newark Advocate Posted: 09 Jan 2010 07:25 AM PST NEWARK -- Foreclosure filings in Licking County declined in 2009 for the first time since the mid-1990s, possibly signaling better days ahead for homeowners and a battered housing market. The drop was minimal, less than 2 percent, and foreclosures exceeded 1,000 for a fourth consecutive year. Foreclosures soared almost 40 percent from 2005 to 2008, but fell from 1,202 in 2008 to 1,181 in 2009. Still, with the county and state reeling from the worst recession in possibly 70 years, any positive signs are significant, especially in a housing market at the center of the economic downturn. "I think the banks are working with people," said Mark Evans, executive officer of the Licking County Board of Realtors. "That's a positive sign in our community. We don't see as many foreclosures now because of banks willing to work on short sales." In a short sale, the lender allows the sale of the house for less than the amount owed by the homeowner. It avoids a lengthy foreclosure proceeding, during which the property deteriorates, and allows the bank to recover most of its investment sooner. "Those foreclosed homes that eventually sell, sell well below market value and negatively affect the values of someone's home and around the neighborhood," Evans said. "The higher number of foreclosures, the lower the average sale price in our market." Home sales surged in the fall, bringing the number of transactions in 2009 to within 3 percent of 2008, but sale prices remained low. The average sale price was $129,312 in 2009, compared to $151,122 in 2008, through 11 months. It's unclear whether the slight decline in foreclosures reveals the local economy has hit bottom and started to recover, or more bad news lies ahead. "What I'm hearing is we may have a little bit of a lull at the moment, but there's anticipated in the next year or two, we're bound to see another round of them," said Debbie Tegtmeyer, executive director of the Licking County Coalition for Housing. The reason for the expectations, Tegtmeyer said, are predictions that adjustable rate mortgages are due to adjust up again, which could force homeowners struggling to make payments into foreclosure. "And, we still have a lot of people out of work," Tegtmeyer said. "Unemployment benefits have been extended, but unemployment does not equal the salary before being laid off." Cheryl Snyder, senior vice president/head of retail banking at Park National Bank, said she is not ready to proclaim the slight drop in foreclosures a trend. "Some of the programs that the government put out last year may have temporarily stalled some of the foreclosure activity," Snyder said. One of the new requirements calls for a trial period before a foreclosure, when the lender and borrower can work on modifying the payments. "The foreclosure actions are stalled during that time, so it's premature to make any conclusions," Snyder said. "It could be just a matter of timing. But, we're encouraged, at least, it did not increase in 2009." The Advocate classified section listed three pages of sheriff's sales in Thursday's edition. Sixteen foreclosures already have been filed in the new year, according to Common Pleas Court records, so the good news might be short lived. Scott Torguson, a legal aid attorney with Southeastern Ohio Legal Services, said the statistics show foreclosures have leveled off, but not that things are necessarily getting better. "I don't think it's getting worse," Torguson said. "If it got any worse, it'd be such a huge disaster. I think we've hit rock bottom. It may stay like it is a couple years and then improve." The county had 5,508 foreclosure filings from 2005-09, compared to 4,183 in the previous 10 years, from 1995-2004. "There's a point where (banks) stopped giving as many bad loans, so that's going to help," Torguson said. "I wouldn't be surprised if it went up a little next year, or down a little bit. We have revised down our 2009 growth forecast for Malaysia from 3.1% to 1.4% after the latest industrial production data revealed that factory output contracted at its fastest pace in seven years in November. He said agreement on the use of the military assets was a follow-up to the decision of the ASEAN Defence Ministers' Meeting (ADMM) in Kuala Lumpur in 2005 which called on the defence sector to also participate in the realisation of ASEAN's goal of forming a regional community that was happy, peaceful, safe and stable. We continue to expect that the Malaysian government will increase defence spending by 4% annually, in real terms, over the coming years.
